In Hawaii, there are four classes of sex crimes—first to fourth-degree. First-degree sex crimes are the most serious and fourth-degree crimes the least. For example, knowingly engaging in sexual penetration with a person 14 years of age or younger is a first-degree offense whereas purposefully exposing genitals to another person would likely be considered a fourth-degree crime.
The breakdown of potential punishments is as follows:
- First-degree sexual assault/Class A felony: Punishable by up to 20 years of imprisonment and a fine of up to $50,000.
- Second-degree sexual assault/Class B felony: Punishable by up to 10 years of imprisonment and a fine of up to $25,000.
- Third-degree sexual assault/Class C felony: Punishable by up to five years of imprisonment and a fine of up to $10,000.
- Fourth-degree sexual assault/Misdemeanor: Punishable by up to one year in jail and a fine of up to $2,000.
